1. About these terms

This website, bonjourmedical.com (the "Site"), is operated by Bonjour Medical ("we," "us," "our"), 4392 Dominion Blvd, Glen Allen, VA 23060. By using the Site or buying from us, you agree to these Terms of Service and to the policies they refer to, including our Purchase Terms & Warranty, Refund Policy, Shipping Policy and Privacy Policy. If you don't agree, please don't use the Site.

For equipment purchases, the Purchase Terms & Warranty also apply. If they conflict with these Terms of Service, the Purchase Terms & Warranty control for that purchase.

2. Who can buy

  • You must be at least 18 years old to create an account or place an order.
  • A caregiver or legal guardian may order on a patient's behalf. If you order for someone else, you agree to these terms for that order and confirm you're authorized to act for the patient.
  • We currently sell and deliver only to addresses in Virginia and Maryland.

3. Prescription equipment

  • Some products, including the Cold Compression Pro, require a valid prescription from the patient's provider. We don't ship these products without one.
  • Your card is approved at checkout and charged when we receive the prescription. If we don't receive it within 7 days, we cancel the order and release the hold.
  • Workers' compensation and VA equipment is not sold through this Site and follows that program's rules.

4. Not medical advice

We supply medical equipment. We don't provide medical advice, diagnosis or treatment. Information on the Site, including our videos and how-to guides, is general and doesn't replace the advice of the patient's provider. Use equipment only as prescribed and as described in the manufacturer's instructions. Stop and contact the provider if there is pain, numbness, skin changes or any other problem. In an emergency, call 911.

5. Products, prices and orders

  • Prices are shown to signed-in customers and can change without notice. The price shown at checkout applies to your order.
  • We try to describe products accurately, but we don't guarantee that descriptions or images are error-free. We may correct errors and may cancel an order affected by an error, including after it is placed, before your card is charged.
  • We may refuse or cancel any order, limit quantities, or stop offering a product at any time.
  • Refunds depend on the product. Unless a product's page or order paperwork says otherwise, all sales are final. See our Refund Policy.

6. Your account

You're responsible for keeping access to your email account secure, because we use one-time codes sent to your email to sign you in. Please give accurate information, including the patient's full name exactly as it appears on the prescription.

7. Privacy

Please don't enter medical information on the Site, in order notes or in regular email. Prescriptions come to us directly from the provider's office by fax. How we handle personal information is described in our Privacy Policy.

8. Acceptable use

You agree not to use the Site for any unlawful purpose, submit false information, interfere with the Site's security or operation, or copy or reuse Site content without our written permission.

9. Third-party services and links

The Site runs on Shopify, and payments are processed by third-party payment providers. Links to other websites are provided for convenience; we aren't responsible for their content or practices.

10. Warranties and disclaimers

Equipment warranties are described in our Purchase Terms & Warranty. Except for those warranties and to the extent allowed by law, the Site and its content are provided "as is," without other warranties of any kind, express or implied.

11. Limitation of liability

To the extent allowed by law, our total liability for any claim related to a purchase is limited to the amount you paid for it, and we are not liable for indirect, incidental or consequential damages.

12. Indemnification

You agree to indemnify and hold Bonjour Medical harmless from claims arising from your breach of these terms or your misuse of the Site or any product, to the extent allowed by law.

13. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules.

14. Changes

We may update these terms by posting a new version on the Site. The version posted when you place an order applies to that order.
